Major Family Law Related Legislation In Pakistan

Following are the different family laws in Pakistan that regulate various family affairs:

  • MUSLIM FAMILY LAW ORDINANCE, 1961

This is an ordinance to regulate and to give effect to certain recommendations of the commission on marriage and family laws. This ordinance gives guidelines and rules regarding registrations of marriages, polygamy, talaq (divorce), succession, dissolution of marriages, maintenance, Dower etc.

  • FAMILY COURT ACT, 1964

Family courts act provides the structure of a family court, how it is composed and how a family court works and what is the limitation of a family court, furthermore family court act gives the procedure of a family trial that includes summoning of the defendant, recording of evidence, fixation of interim or final maintenance of wife and child if any, formation of a commission, and then final disposal of family suits. In short a family court act provides the establishment of family courts for the expeditious settlement and disposal of disputes relating to marriage and family affairs and for matters connected therewith.

  • DISSOLUTION OF MUSLIM MARRIAGE ACT, 1939

This is an act to consolidate and clarify the provisions of Muslim Law relating to suits for dissolution of marriage by woman married under Muslim Law and to remove doubts as to the effect of renunciation of Islam by a married Muslim woman on her marriage. In short this act tells rules specifically regarding a Muslim Marriage and its dissolution.

  • CHILD MARRIAGE RESTRAINT ACT,1929

This is an act to restrain the solemnization of child marriage, according to this Act child, if male, is under eighteen years of age and if female under sixteen years of age. This act provides the ways to restrain a child marriage and penalty or punishment of doing the same.

  • MARRIAGE FUNCTION ( PROHIBTION OF OSTENTATIOUS DISPLAY AND WASTEFUL EXPENSES)
